 # Terms of service

## 1. Acceptance of Terms

 By accessing or using the Publica Now platform ("Platform"), operated by Queryloop Inc ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

 These Terms constitute a legally binding agreement between you and the Company. By creating an account, browsing content, or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms and our [Privacy Policy](/privacy).

 

## 2. Account Registration

 To access certain features of the Platform, you must create an account. When registering, you agree to:

- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate and complete.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
 
 You must be at least 18 years of age or the age of legal majority in your jurisdiction to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

 

## 3. Creator Responsibilities

 If you use the Platform to publish and sell content ("Creator"), you agree to the following:

- You own or have obtained all necessary rights, licenses, and permissions for any content you publish on the Platform.
- Your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
- You are solely responsible for the accuracy, quality, and legality of your content.
- You will comply with all applicable laws and regulations in your jurisdiction, including tax obligations related to income earned through the Platform.
- You will not use the Platform to distribute malware, spam, or any other harmful material.
- You will respond to buyer inquiries and disputes in a timely and professional manner.
 
 Publica Now does not claim ownership of any content you publish. You retain all rights to your work. By publishing on the Platform, you grant us a non-exclusive, worldwide license to display, distribute, and promote your content solely for the purpose of operating the Platform.

 

## 4. Intellectual Property

 The Platform, including its design, code, logos, trademarks, and all related materials, is the property of Queryloop Inc and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.

 Content published by Creators remains the intellectual property of the respective Creator. Buyers receive a personal, non-transferable license to access purchased content for private use. Buyers may not redistribute, resell, or publicly display purchased content unless expressly authorized by the Creator.

 If you believe that content on the Platform infringes your intellectual property rights, please contact us at <support@publica.now> with a detailed description of the alleged infringement.

 

## 5. Purchases and Refunds

 All purchases made through the Platform are processed by Stripe, Inc., our payment provider. By making a purchase, you agree to Stripe's terms and conditions in addition to ours.

 Prices for content are set by Creators and displayed in the applicable currency. All prices are inclusive of any applicable platform fees. Publica Now charges a transaction fee of 15% plus a USD 0.30 fixed fee per transaction, which is deducted from the Creator's earnings.

 Because digital content is delivered immediately and cannot be returned, sales of digital content are generally final. However, refunds may be granted in the following circumstances:

- The content is materially different from its description.
- Technical issues prevent access to the purchased content and cannot be resolved.
- Duplicate purchases made in error.
 
 Refund requests must be submitted within 14 days of purchase to <support@publica.now>. We review each request on a case-by-case basis and reserve the right to deny refunds where the content has been substantially consumed.

 Printed books are physical goods and are covered by Section 6 below, not by this Section.

### 5.1 Creator earnings and payouts

 Your share of every completed sale is credited to your Publica Now balance. The balance is money we hold for you; it is not a credit, it does not expire, and we do not charge you to hold it or to send it.

 **You may request a withdrawal at any time, once your balance exceeds USD 100.** That threshold is the only condition. There is no payout schedule, no waiting period, no minimum time between requests, and no different rule for one country or payout method than for another. A withdrawal always transfers the whole balance.

 Where the money goes decides only the currency it arrives in: a bank account in Argentina settles in Argentine pesos, and every other bank account in US dollars. Withdrawals to a connected Stripe account are transferred automatically; withdrawals by Wise or bank transfer are processed by us by hand, and we will tell you by email when yours has been sent. If a transfer fails, the amount returns to your balance and you can correct your details and request it again.

 Sales settled directly to your own connected Stripe account never enter this balance, because that money has already reached you.

 

## 6. Printed Books

 Some works are also offered as printed books. Printed books are **made to order**: no copies are held in stock, and each order is manufactured by a third-party print and fulfilment partner after your payment is taken, routed by destination. That partner receives the name, delivery address and phone number needed to produce and ship your parcel, and nothing else. See our [Privacy Policy](/privacy).

### 6.1 Production and delivery times

 Checkout shows an estimated production and delivery window for the shipping method you choose. Those windows are estimates provided by our manufacturing and carrier partners, not guarantees. Printing typically begins within one to two business days of your order and cannot be varied by us once it has begun.

### 6.2 Cancelling an order

 Because each copy is manufactured for you individually, an order can only be cancelled before printing begins. Email <support@publica.now> as soon as possible and we will cancel and refund in full if the copy has not yet entered production. Once it has, Section 6.3 applies instead.

### 6.3 Returns and refunds on printed books

 We will replace or refund a printed book, at your choice, where:

- it arrives damaged, misprinted, misbound or otherwise defective;
- it is not the book you ordered;
- it does not arrive within 30 days of the end of the estimated delivery window.
 
 In addition, and whether or not you are required by law to be offered it, you may change your mind about a printed book within **14 days of delivery** and ask us for a refund. We will refund the price of the book. We do not ask you to ship the copy back to us: return postage on a paperback usually costs more than the book, so the copy is yours to keep, pass on or recycle.

 Refunds are issued to the original payment method and normally appear within five to ten business days, depending on your bank. Contact <support@publica.now> to start any of the above.

### 6.4 Delivery addresses

 You are responsible for the accuracy of the delivery address you give at checkout. We cannot change an address once printing has begun. If a parcel is returned to sender or destroyed because the address was incomplete or incorrect, we will refund the price of the book but not the shipping and handling already spent on the attempt.

### 6.5 Import duties and taxes

 Printed books are manufactured in the facility our partner selects, which is not always in the country the book is shipped to. Where a parcel crosses a customs border, **import duties, customs charges or local taxes may be payable by the recipient** on delivery, and are not included in the price shown at checkout. Since 1 July 2026 this includes a per-item duty on books entering the European Union from outside it. We cannot predict, quote or reimburse those charges, and a parcel refused at customs is treated as an incorrect-address case under Section 6.4.

### 6.6 What a printed copy includes

 Buying a printed book buys that physical copy. It is not a licence to the work and does not grant access to any digital edition of it — a digital edition, where the Creator offers one, is a separate purchase. Printed copies are sold for personal use and may not be reproduced or resold commercially.

### 6.7 If you are the Creator of a printed book

 Printed books work differently from digital ones on the Creator's side, because we buy the manufacturing. The following applies in addition to Section 3, and in place of the fee described in Section 5, for every printed copy sold.

- **Your earnings are a share of the margin, not of the cover price.** The margin on a copy is its retail price minus what the printer charges us to manufacture it. Our fee — 15% plus a USD 0.30 fixed fee, or your own agreed terms if they are better — is taken from that margin, and the remainder is yours. On a printed book our fee is therefore a smaller amount of money than the same fee on a digital sale of the same cover price, and your earnings are smaller too, because the printing has to be paid for.
- **The manufacturing cost is quoted, not fixed.** It depends on the format and page count of your book, and printers change their prices. The cost shown to you when you set a price is the cost quoted at that moment; the cost actually charged is re-quoted when a buyer orders. You may not list a printed book below its floor — the manufacturing cost plus the fixed fee — and we may stop offering a book in print if its price falls below the floor after a cost change.
- **You are paid when the copy ships, not when it is bought.** A printed order can be cancelled or rejected between payment and production, and a copy that is never manufactured earns nobody anything. Your share is credited to your balance when the parcel ships, and becomes withdrawable then, on the terms in Section 5.1.
- **A refunded order reverses your earnings for it.** If a buyer is refunded in full for a copy that had already shipped, the share credited for that copy is removed from your balance. If you had already withdrawn it, we absorb the difference rather than carry your balance below zero — we will not ask you to repay it. A partial refund, such as making good on damaged postage, does not affect your earnings.
- **Shipping is not revenue.** What a buyer pays for shipping and handling is passed through to the carrier and the cost of collecting it. It never forms part of the margin and never forms part of your earnings.
- **You are responsible for what gets printed.** The interior file and cover you supply are manufactured as supplied. We do not proofread, redesign, or correct them, and a reprint caused by an error in your own file is not a defect under Section 6.3.
 
 Offering a work in print is per-work and optional. You may stop offering a printed edition at any time from the work's print settings, and put it back on sale later at a price that meets the floor then in force. Copies already ordered will still be manufactured and shipped.

 

## 7. Subscriptions

 Certain Creators offer subscription-based access to their content through membership tiers. By subscribing, you authorize recurring payments at the frequency and price specified at the time of subscription.

 You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to the subscription content until that date. No partial refunds are provided for unused portions of a billing period.

 

## 8. Prohibited Content and Conduct

 You may not use the Platform to publish, distribute, or promote content that:

- Is illegal, defamatory, threatening, harassing, or discriminatory.
- Contains sexually explicit material involving minors.
- Promotes violence, terrorism, or hate speech.
- Infringes upon the intellectual property or privacy rights of others.
- Contains malware, viruses, or any harmful code.
- Is fraudulent, misleading, or deceptive.
- Violates any applicable law or regulation.
 
 We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of repeat offenders without prior notice.

 

## 9. Termination

 You may close your account at any time by contacting us at <support@publica.now>. Upon account closure:

- Your access to the Platform will be revoked.
- Any balance you have already earned remains yours, and any withdrawal you have already requested is still processed. There is no payout schedule to wait for — see Section 5.1.
- Purchased content may no longer be accessible after account termination.
- Content you published as a Creator will be removed from the Platform within a reasonable timeframe.
 
 We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law. We will make reasonable efforts to notify you before or promptly after such action, except where prohibited by law.

 

## 10. Limitation of Liability

 To the maximum extent permitted by applicable law, Queryloop Inc, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Platform.

 Our total liability to you for any claims arising from or related to these Terms or your use of the Platform shall not exceed the greater of: (a) the total fees paid by you to Publica Now in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD $100).

 The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

## 11. Governing Law

 These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict of law provisions.

 

## 12. Dispute Resolution

 Any dispute, controversy, or claim arising out of or relating to these Terms shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved within thirty (30) days of written notice, either party may submit the dispute to binding arbitration administered by the Centro de Arbitraje y Conciliacion de la Camara de Comercio de Bogota, in accordance with its rules.

 The arbitration shall be conducted in Bogota, Colombia, in the Spanish language. The arbitral award shall be final and binding on both parties. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

 

## 13. Changes to Terms

 We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on the Platform and updating the "Last updated" date. We may also send you a notification via email or through the Platform.

 Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and close your account.
